فكما أعلنا من قبل [انظر هـنـا من فضلك]،
تتطلع "عتيدة" إلى المساهمة في توسيع الآفاق المعرفية المتخصصة لأعضائها وزوراها الكرام.
من هذا المنطلق، يسعدنا أن نتابع هذه "الأسابيع" بـ

أسبوع اللغة العربية

وذلك ابتداء من 1/2/2009 وحتى 7/2/2009

أهداف "أسبوع اللغة العربية"

- نشر اللغة العربية والتعريف بها
- تعزيز العربية الفصحى من الناحية التطبيقية بين مستخدميها



أنشطة "أسبوع اللغة العربية"

- تناول كل ما يتعلق باللغة العربية، نظريةً وممارسةً، بالمدارسة والمناقشة؛
- نشر الأخبار والمقالات والدراسات المتخصصة في مختلف مجالات اللغة العربية؛
- التعريف بالشخصيات المشتغلة باللغة العربية؛
- تفعيل دَور المؤسسات والهيئات والجمعيات المشتغلة باللغة العربية؛
- تشجيع الأعضاء على الكتابة بلغة عربية سليمة خالية من الأخطاء؛
- إغناء جميع الأبواب المدرجة ضمن قسم "لغة ولسانيات"
وتفعيل المشاركة في جميع المواضيع المدرجة تحته.

نتمنى من الجميع المشاركة الفعالة تعميما للفائدة المشتركة.
ونذكركم بأن هذا الأسبوع مخصص للغة العربية دون سواها،
اللهم إلا ما كان مستعجلا مثل السؤال عن ترجمة عبارة من العبارات وما إلى ذلك.

Accessory After the Fact

 

يُعَرّفُ 'حافظ محمد أنور بن مهر' التستر عن الجريمة في كتاب 'التستر والإيواء في الفقه الإسلامي' على أنه 'إخفاء الشخص المجرم والمطلوب بحق، وستر فعله وكتمان خبره عن السلطات الأمنية أو عن صاحب الحق وغيره من الناس؛ بغرض تخليصه من العقوبة أو تفويت حق الغير أو الإضرار بصاحب الحق'. 

 

وعموماً، ينقسم التستر عن الجريمة في القانون المغربي الجنائي إلى نوعان: 'التستر القبلي'، أي التستر على الجريمة قبل وقوعها، ويعتبر هذا النوع جريمة تامة تتوفر فيها جميع أركان الجريمة (العنصر المادي، المعنوي والقانوني) التي لا تُسْقِط بأي حال من الأحوال المسؤولية الجنائية عن فاعلها لأن المتستر عليها كان على دراية بها حتى قبل وقوعها؛ ومن جملة التهم التي سيواجهها المتستر في هذه الحالة 'التستر على الجريمة والمشاركة المعنوية والمسؤولية التقصيرية ...إلخ '.

 

أما النوع الثاني فيسمى بـ'التستر البعدي' أي التستر على مرتكب الجريمة بقصد أو بغير قصد بعد حدوثها. ويضع هذا النوع الآخر من التستر مرتكبها في قفص الاتهام غير أنه يستفيد من ظروف التخفيف التي يمكن أن تصل إلى الغرامة المالية فقط أو العقوبة الحبسية مع وقف التنفيذ وإبقاء الغرامة وذلك حسب درجة خطورة التستر والجريمة المرتكبة.

In Moroccan Penal Law, there are two sorts of `Accessories; a) accessory after the fact and b) accessory before the fact. As for the latter, it is universally considered as a direct accomplice in the offence because the offender has a prior knowledge about the offence. In case the `mens rea (Guilty Mind العنصر المعنوي) and the `actus rues (Guilty Actالعنصر المادي ) are both associated, the offender will be given a confinement sentence with a compulsory fine.

In regards to the second sort, the offender shall be given a suspended prison sentence with a heavy fine or a six-month prison sentence with or without a fine if there are no mitigating circumstances in the case.

باختصار معنى هذا المصطلح في القانون الإنجليزي/الأمريكي ينطبق على الشخص الذي يساعد مرتكب أو مرتكبي الجناية عبر التستر عليهم أو إخفائهم أو تهريبهم من قبضة العدالة أو المحاكمة. ويشترط في الشخص المتواطئ مع مرتكب الجناية علمه بوقوع الفعل ـ الجنايةـ ، كما لايعتبر الشخص المساعد مذنبا في رأي القانون في حال وقوع جنحة ـ كمخالفة سير مثلا ـ وليس جناية

إلى الأخت وفاء وباقي الإخوة الكرام،
السلام عليكم ورحمة الله وبركاته. إني أعتذر على الكتابة باللغة العربية ولكني قد اتخذت القرار بالكتابة بها لسببيْن: السبب الأول أن السؤال قد طرح بالعربية والسبب الثاني أني لا أفهم الفرنسية ولا يمكنني الكتابة بها. فبالنسبة للسؤال المطروح من قبل الأخت وفاء فأردت أن أقول إني بحثت في قاموس الفاروقي ولم أجد المصطلح الموضوع للمناقشة أي النكول ولا أرى عدم وجود المصطلح في المعجم المذكور إلا تقصيرا منه إلا في حالة عدم استخدامه في الشرق العربي. وحينما لم أعثر عليه في الفروقي بحثت في معجم آخر ووجدته في قاموس قانوني عربي - أسباني (للدكتور مانويل فيريا) حيث يقول:
نكول
negativa (en especial a prestar juramento)
وأظن أنها الترجمة المناسبة إلى الأسبانية وقد تكون قريبة من الفرنسية لكونهما لغتين شقيقتيْن إن صح التعبير...

Serment Dcisoire

قاعدة النكول أو النكول عن اليمين الحاسمة

 

Le serment qui est dfr par une partie l'autre en application de l'article 317 du de Procdure civile est qualifi de "dcisoire" en ce que, lorsqu'il a t prt, la motivation de la dcision du juge doit tenir pour tablis les faits sur lesquels le serment a port.

A l'adjectif "Dcisoire" s'oppose l'adjectif "suppltoire" qui qualifie le serment dfr pour complter un commencement de preuve par crit. Le serment suppltoire peut tre dfr d'office par le juge.

 

 

يعرفّ ابن أبي الدم 'النكول' في كتاب "أدب القضاء" لغةً على أنه 'النكص والجبن والامتناع عن اليمين'. أما اصطلاحاً فيعرفهُ ابن عرفة في 'تبصرة الحكام' على أنه 'الامتناع عن اليمين الموجهة من الحاكم إلى المدعى عليه، أو المدعي'.

والنكول نوعان، الأول حقيقي وهو أن يقول المدعي عليه إذا وجه له القاضي الدعوة للحلف 'لن أحلف' فيقول له القاضي: 'إني أعرض عليك اليمين، فإما أن تحلف وإلا جعلتك ناكلاً وحكمت عليك'. أما النوع الثاني فيسمى النكول الحكمي وهو أن يعرض القاضي اليمين على المدعى عليه فيسكت ولايجيب، فيكون بذلك ناكلاً'

Serment Dcisoire

قاعدة النكول أو النكول عن اليمين الحاسمة

 

Le serment qui est dfr par une partie l'autre en application de l'article 317 du de Procdure civile est qualifi de "dcisoire" en ce que, lorsqu'il a t prt, la motivation de la dcision du juge doit tenir pour tablis les faits sur lesquels le serment a port.

A l'adjectif "Dcisoire" s'oppose l'adjectif "suppltoire" qui qualifie le serment dfr pour complter un commencement de preuve par crit. Le serment suppltoire peut tre dfr d'office par le juge.

 

 

يعرفّ ابن أبي الدم 'النكول' في كتاب "أدب القضاء" لغةً على أنه 'النكص والجبن والامتناع عن اليمين'. أما اصطلاحاً فيعرفهُ ابن عرفة في 'تبصرة الحكام' على أنه 'الامتناع عن اليمين الموجهة من الحاكم إلى المدعى عليه، أو المدعي'.

والنكول نوعان، الأول حقيقي وهو أن يقول المدعي عليه إذا وجه له القاضي الدعوة للحلف 'لن أحلف' فيقول له القاضي: 'إني أعرض عليك اليمين، فإما أن تحلف وإلا جعلتك ناكلاً وحكمت عليك'. أما النوع الثاني فيسمى النكول الحكمي وهو أن يعرض القاضي اليمين على المدعى عليه فيسكت ولايجيب، فيكون بذلك ناكلاً'

On retrouve ce concept dans les jugements de divorce judiciaire.
dans le code de la famille il est question de prter serment par l'une des parties sans autre prcision
